Additional Terms & Conditions: Installations.
These terms and conditions of sale apply to all contracts between us and you in connection with the sale of goods and services from Hearth & Home.
DEFINITIONS
In these conditions the following words shall have the following meanings:
“Buyer”, “you” or “your” means the company, firm, consumer, or person who buys
or agrees to buy the Goods and/or Services from the Company.
“Company”, “we”, “us” or “our” means Fireplace Factory Outlet Limited T/A Hearth & Home (company no: 12087493).
“Conditions” means the terms and conditions of sale set out in this document.
“Contract” means any contract for the sale of Goods and/or Services from the Company trading as Hearth & Home to the Buyer incorporating these Conditions.
“Goods” means the products, articles or things as described in your sales receipt, invoice, order, or quote.
“Order” means any such written instruction that is set out in a quote to supply the Goods and/or Services incorporating these Conditions.
“Services” means services provided by the Company trading as Hearth & Home to the Buyer as described in your sales receipt, invoice, order or quote.
“Hearth & Home” means the trading division of the Company Fireplace Factory Outlet Limited trading under the name Hearth & Home.
1. Quotations
1.1 All our quotations are fully inclusive & fixed. This means that our price will be honoured no matter how difficult the installation. In circumstances where the nature of the task becomes different to the one originally quoted, additional costs will be incurred but will be quoted before we commence.
1.2 Where an error or omission has been made to a quotation, we reserve the right to re-quote or decline the job before commencing. Please check any quote includes all the options & work you are expecting. Sometimes manufacturers will show products that have chargeable options shown. If you are expecting something to be included & it is not shown, please ask.
2. Preparation
2.1 When we undertake to protect the room, although we take every care in the work we do, & normally raise no, or minimal dust, we cannot guarantee no dust will be produced.
2.2 If you are particularly concerned for your room or decorations, we would recommend you cover all furnishings in the room or remove items which may be affected.
3. Cancellation or inability to access the property.
3.1 If we receive cancellation notification less than 24 hours prior to agreed appointment time, or for any reason we arrive on site for an agreed appointment & we are unable to gain access to the property to carry out our work, we reserve the right to make full charge for the labour element of the work assigned to be carried out.
4. Job overruns.
4.1 If we are unable to complete any task in the allocated time, we will re-schedule as soon as is possible, this may a matter of days or weeks depending on the time of year or the amount of other scheduled work. Where we are unable to attend at an agreed appointment time or day, we will not be held responsible for any consequential costs or charges.
5. Media Wall or Installation Payments
5.1 A minimum 50% deposit is required when ordering with the balance due prior to any work commencing.
6. Outstanding Invoices
6.1 Under the “late payments to small business act”, all outstanding invoices more than 60 days will automatically incur an £80 surcharge & will be subject to interest @ 15% above base rate. Furthermore, all costs of recovery will be the liability of the customer. Any special prices offered are strictly subject to payment on completion. All bounced cheques will incur all our bank charges. All goods supplied and or fitted remain the property of the company until paid for in full.
7. Goods delivered to site.

8. Fitting/utilising customers own equipment/materials:
8.1 We cannot guarantee any products not supplied by us; items may become damaged during installation. Where this occurs, we cannot be held responsible for the replacement item. Where items are defective or not compatible, additional material & fitting costs will be incurred to rectify the situation.
9. Plastering & Rendering:
9.1 When rendering or plastering a chimney breast or false constructed chimney breast/’media wall’ some small shrinkage cracks may appear after drying. Inset fires that abut a plastered wall can be prone to plaster “crazing”. We will undertake to return once to rectify this at our own expense but if it re-occurs, we would suggest some modification to the surrounding area. Neither skirting board replacement or re decoration, are normally included in our quotation of works, unless specifically included. We cannot be held responsible for any damage that may occur to the customers’ existing fireplace, decor, plaster, or skirting board around the installation. The Company will not re-fit skirting boards, coving, or carpets as these are specialised skills.
10. Marble/granite & limestone fitted.
10.1 As marble/granite is not naturally fire resistant, the higher the temperature reached the more likely the marble/granite will crack. By slabbing the marble all we are doing is reducing the amount of heat reaching the marble. By cutting the marble into three pieces we are introducing expansion joints, which reduces the possibility of the marble cracking, however in no way does this make marble heat resistant or crack-proof. We as a company cannot accept any claims for any slabbed panels and hearth cracking after installation.
